No Grievance Resolution Provided Following Teen Patient's Sexual Assault

Brynn Marr Hospital was cited by the Centers for Medicare and Medicaid Services (CMS) for failing to provide a prompt resolution to a patient/guardian’s grievance. A patient’s mother alerted staff that her 15-year old son was sexually assaulted by another patient while he bent over to brush his teeth. While an internal investigation into the incident was conducted, the parent was not notified of the resolution. Administrative staff at the facility stated, “I did complete an investigation but I did not follow up with the patient’s mother…I should have filed a formal grievance and followed our process but I did not do this…I did not send the patient nor his mother a letter of resolution…” As a result, the hospital had to submit a plan of correction to address its cited deficiencies and had to modify its deficient policies.
