State Fines Facility for Risk Management Failures After Patient Restraint Injuries

On April 1, 2013, the Florida Agency for Health Care Administration (AHCA) issued a $1,000 administrative fine against Manatee Palms Youth Services for continued noncompliance with risk management requirements. The fine was levied as a result of a second revisit survey conducted on January 17-19, 2013, during which AHCA surveyors found the facility had failed to implement a comprehensive risk management program and enact proactive measures to protect two patients from injuries during restraint use. Two patients sustained cuts and laceration injuries after being restrained, and the facility failed to conduct an investigation or assessment to address how the injuries could have been prevented. AHCA found that the failure to implement a risk management process is not only “unacceptable and a violation of law,” but “places patients at risk and could lead to a system failure in regards to minimizing risk.”
