Whistleblower Claims Hartgrove Hospital Violates Regulations Leading to Medicaid Fraud; Case On Appeal

Relator, at the time of filing, was a nursing counselor at Hargrove Hospital and worked there since October 2009. Relator claimed that Hartgrove is admitting patients beyond their licensed bed capacity of 150 beds. Relator claimed that Hartgrove agreed to follow all regulations when agreeing to participate in the Illinois Medicaid program. However, Relator argued, Hartgrove is clearly violating their approved number of beds and thus violating the terms of the Illinois Medicaid program.

The District Court granted summary judgment for Hartgrove on Oct. 5, 2015.

Relator appealed to the Seventh Circuit and that appeal has been stayed pending the outcome of Universal Health Services, Inc. v. United States ex rel Escobar, 15-07 currently before the Supreme Court of the United States.
